The Donald J. Trump for President campaign and the Republican National Committee filed suit on Tuesday against the United States District Court for the District of Nevada to invalidate Nevada Democrats’ unconstitutional Assembly Bill 4 (AB4), which if passed, would eliminate election safeguards in place for Nevada voters putting millions of ballots at risk this November. This legislation undermines election integrity by mandating universal vote-by-mail and allowing ballots cast after Election Day to be included in the state’s results.
The lawsuit states:
“Every American who is eligible to vote should be able to freely do so. Republicans have always supported efforts to make it easier for voters to cast their ballot. At the same time, however, the electoral process cannot function properly if it lacks integrity and results in chaos. Put simply, the American people must be able to trust that the result is the product of a free and fair election.”
The AB4 creates a slew of problems for Election integrity, voter disenfranchisement, and general chaos in determining the results of the Election. Experts have warned against the tumultuous universal vote-by-mail system for a few key reasons. First, the universal vote-by-mail proposed in AB4 would require Nevada to blindly mail every voter in the state a ballot whether they want one or not. Additionally, these ballots would be mailed without voter verification already creating a problem with veracity before the ballot is even cast.
Ballots cast after Election Day will count under AB4, essentially legalizing ballot harvesting efforts by Democrats and guaranteeing a delay in results beyond Election night. AB4 would permit “voter assistance” in which paid ballot harvesters would complete ballots on behalf of voters 65+, a tactic that would legalize voter intimidation.
Most concerning however, is the clause which allows multiple ballots to be submitted in a single envelope despite the fact that the bill also provides prepaid postage for each individual ballot’s return. This opens the door to rampant voter fraud.
Jenna Ellis, a legal advisor for the Trump 2020 campaign said of the suit:
“Democrats know President Trump is gaining ground in Nevada, so they fully and fundamentally overhauled Nevada’s election laws in a rushed 72-hour attempt to rig the election. This unconstitutional legislation implements the exact universal vote-by-mail system President Trump has been warning against for months, making it nearly impossible for every Nevada voter’s ballot to count. Nevada Democrats are allowing ballots cast after Election Day to count, practically inviting Nevada’s elected liberal leaders to hold the election open until their political operatives harvest enough ballots to swing the election in their favor—ultimately delaying the election. President Trump will not stand for this attack on election integrity, and he is fighting to protect Nevada’s right to vote.”
Simply look to what happened in California this year where according to the AP 102,428 mail-in ballots were disqualified in the state’s 58 counties, about 1.5% of the nearly 7 million mail-in ballots returned. That percentage is the highest in a primary since 2014, and the overall number is the highest in a statewide election since 2010.Or look to the total disaster in New York where The Washington Post reported:
“At the center of this mess is a massive influx of mail-in ballots — 403,000 returned ballots in the city this cycle vs. 23,000 that were returned and determined valid during the 2016 primary — and a system wholly unprepared to process them. It’s not just delayed results that are at issue: In the 12th District and in the primaries across the country, tens of thousands of mail-in ballots were invalidated for technicalities like a missing signature or a missing postmark on the envelope.”
The campaign seeks to invalidate AB4 as unconstitutional. And if history should serve as an example, AB4 would create a nightmare scenario, eliminating Election integrity making it impossible to accurately determine the results of the Election. Paid ballot harvesters would hold the Election open until they received enough ballots to sway the results their way. This unlawful legislation would impede the votes of millions of Nevadans this fall.
